NUISANCES.
If an individual, without authority, for his ,own purposes, or even for the public advantage, constructs a bridge in a public highway, it is incumbent in him to l^eep it in such condition as not to impede the free and convenient use of the highway ; and if he suffers it to become ruinous, so as to be an obstruction, he is guilty of a nuisance, for which he is liable. ...thority, when applied to for a marriage license, to examine a witness on oath as to the age of the parties. Matthew William- son's case, 4; Grat. 554.
2. The authority of a clerk to administer an oath, only extends to oases in which, without regard to circumstances, the taking the affidavit is a necessary prerequisite to the performance of an official act. Ibid.
3. The swearing falsely before a person not authorized to administer the oath, is not perjury. Ibid.
» 4'. The false swearing before a clerk that a person applying for a mar- riage license is over twenty-one years , of age, and thereby obtaining the marrjage license, and the marriage takes place, is a misdemeanor.
