The appellate judges were always royal judges ; in the second instance the courts of the seigniors never intervened. The ecclesiastical jurisdiction had gradually lost ground, thanks to the theory of the ordinary misdemeanor and of the privi- leged case. The ordinary misdemeanor could be retained by the secular judge, as long as it was not required to be transferred ; and in that case only the bailiffs and royal seneschals had juris- diction, to the exclusion of the seigniorial judges. 5 The secular judge was not divested of the privileged cause.
