In limited numbers. — Again, property is a right vested in a human being or a limited num. Ber of human beings. The essence of it, as its name implies, is the appropriation, the making special to an individual or a small group of indi- viduals, of a part of the common stock of things. Some- times, it is true, we speak of public property ; but this is really a contradiction in terms. We signify, in fact, that the thing to which we allude is tiot any one' s property at all, and, therefore, that a...ny one may use it. When we really mean that the thing in question is claimed by a very large but definite body, we do not use the word property, but some word which conveys a different idea. Thus we say that England is the territory of the English people. If we called it their property, we should at once have to admit that no individual Englishman could have any part of it as his roperty ; which is notoriously untrue. Exepcised over subject matter. — Once more, these rights must be exercised over physical subject matter, for that alone is really capable of appropriation.
