This is all that he ventures specifically to assert, and the question raised by it is much narrower than the real question, whether the present legal theory and practice does adequately recognize the equal rights of all to land. Yet, even here, Mr. Spencer clearly suppresses the vital fact. The taking of land for public purposes on payment of compensation — or by process of condemnation, as it is termed — is neither an exercise nor recogni- tion of the supreme ownership of land.
