When Compensation is Due. — Teachers can require trustees to pay them as often at least as at the end of each calendar month of the term of employment. A contract cannot legally be made providing that a teacher shall not be paid until the end of the term. A contract providing that a teacher shall not be paid as often as at the end of each calendar month is not 202 NEW YORK SCHOOL LAW binding, and such teacher can insist upon payments being made at the end of each calendar month. There is no leg...al objection to a contract which provides that a teacher shall be paid oftener than at the end of each month.
(At the close of this chapter the form of contract prepared by the Education Department is given. Any other good form may be used.) Orders on Supervisors and District Collector or Treasurer.
— The law provides that trustees may issue orders on the super- visor of the town and on the collector or treasurer of the district in payment of teachers' salaries. The law also makes it a mis- demeanor for a trustee to issue an order on any of these officers unless there are sufficient funds in the hands of such officer to pay the same.
