209 § 3. No judge, justice, sheriff, or other officer whatsoever, or other person to whom any fees or com- pensation shall be allowed by law for any service, shall take or receive any other or greater fee or reward for such service, but such as is or shall be allowed by the laws of this state, (g) § 4. No fee or compensation allowed by law shall be demanded or received by any officer or person for any service, unless such service was actually rendered by him ; except in the case of charges for ...prospective ■costs, hereinafter specified. But this section shall not prevent any officer from demanding any fee herein allowed for any service, of which he is entitled by law to require the payment, previous to rendering such service, (h) § 5. A violation of either of the two last sections shall be deemed a misdemeanor ; and the person guilty thereof shall be liable to the party aggrieved for treble the damages sustained by him. (i ) § 6. The fees and charges of officers for services rendered to the people of this state, or chargeable to the state, and which have been beretofore audited by the court of exchequer, shall hereafter be audited by the comptroller, and paid on his warrant.
