The court, upon the first point, ruled that though jurisdiction could only be entertained of causes of action recognized by the laws of New York, still, among these, was a judgment rendered in a sister State ; and that the judgment pronounced in Wisconsin must be received as conclusive, regardless of the nature of the original cause of action, which could not now be inquired into. As to the second objection, it was held that the judgment obtained by the defendant for the balance due for the goo...ds concluded the plain- tiffs on nothing, except that they owed the price of the goods ; and that this was perfectly consistent with the liability of the defendant for damages for misrepresenting their quality. The plaintiffs were not bound to recoup, but might avail themselves of the right of suing fqr this wrong.^ A case of considerable interest and importance was decided in the Supreme Court of Louisiana in 1858, involving this question of the conclusiveness of judgments rendered in the sister States.
