691 ACTIONS BY AND AGAINST CARRIERS OF FREIGHT § 2732 man on the deposit of the goods at a place of safety ready for delivery to the consignee on demand, must affirmatively prove that this usage was of an established and general nature, and that the notices given in pursuance thereof, were of such char- acter as to indicate or to reasonably warrant the inference, that the company intended to remain liable as a common carrier until the consignee in each instance, has had reasonable time and opportunity to remove his goods."® Where there is no dispute as to the facts the question whether proper care has been exercised may become a question of law for the court,"'' but it is usually a question for the jury."* , §2732 (1712).
