THE INDIVIDUAL AS TRUSTEE 49 court. 1 Thus a trustee cannot appoint an agent to sell the property 2 or to manage the real estate,... or hand the funds to a solicitor to invest, 3 because by doing so he delegates the essential part of his power, namely, the exercise of his discretion in determining the selling or letting prices, or the need of repair, or the appropriateness of the security selected for investment. 4 This does not prevent the trustee from intrusting the unessentials to an agent, 6 such as the delivery or execu- tion of a deed or lease, or any other matter not requiring the exercise of discretion, unless the trust instrument requires his personal execution of these unessential mat- ters.
