The power of the President to appoint to office, with the advice and consent of the Senate, was early in the history of the government construed to mean that he might remove, at his pleasure, all officers appoi...nted and commissioned by him, unless the Con- stitution itself had fixed their tenure of office. The Constitution, for example, provides that the judges of the courts of the United States shall hold their offices during good behavior. These the President cannot remove; but most of the officers appointed by him, according to the long established doctrine and prac- tice, whether civil or military, were removable at his pleasure. But Congress, by the act of fifth April, eighteen hundred and sixty-nine, has provided that civil officers, appointed by and with the advice and consent of the Senate, shall not be removed, unless with the like advice and consent.
