Batchelder, Esq., was secured as counsel, who, having brought the mat- ter to the attention of the Superior Court, a decree was issued, a copy of which is included in this report. Interlocutory Petition, In the above entitled actio...n the School District of the Town of Danville moves that said action be brought for- ward. In the above entitled case the School District of the Town of Danville represents that in accordance with the decree of this Court handed down at the January Term, 1911 and the amendment thereto handed down at the April Term, 1911, a building was constructed and the School District established a High School and conducted the same over a period of years ; 25 26 That it became apparent that said School was not of sufficient size to be conducted economically per capita, nor to be cojiducted beneficiall}'^ from' an educational standpoint, and after a few years the said School was dis- continued and has not since been re-opened and cannot be re-opened and conducted advantageously ; That the said fund with its accumulations amounts at the present time to twenty-two thousand dollars ($22,- 000.); That the petitioner by virtue of certain statutory enact- ments since the decree of April, 1911, is obliged to pay the tuition of all scholars attending approved High Schools outside of the borders of said Town ; but that the payment of said tuition is only a small portion of the cost to the pupils attending said approved St^hoois, over and above the cost to them of obtaining a JTigh • School education, if a High School was conducted in the Town of Danville, the additional costs being largely the cost of transportation ; That the income from said fund, if it should be divid- ed equally among the pupils of the Town of Danville who attend approved High Schools outside of the borders of said Town would not reimburse them or any of them for the amount expended for transportation.
