Aquino continúa diciendo : Resuelto como queda que el reivindicante no ha justificado los extremos requeridos por el art° 2758 del Cód. Civ., se desprende, como consecuencia ló- gica, la justicia de esa resolución, y como tal opino que debe confirmársela en todas sus partes, debiendo cargar con las costas de esta instancia el apelante, en virtud de la prescripción del Cód. de P., art. 299. Voto en consecuencia en este sentido.
Sobre esta cuestión, el Dr. Balbastro dijo: No obstante lo dispuesto... por el Cód. de P. en su art^ 299, y confirmándose la sentencia por haberse alegado la prescripción, voto por que las costas se paguen en el orden causadas por cada parte, y las co- munes por mitad.
El Dr. Sayanca adhirió á este voto.
Con lo que terminó el acuerdo, pasado y firmado por ante mí, Secretario, de que doy fé.
SENTENCIA N^ 19. Corrientes, Mayo 24 de 1897.
