MITCHELL. 49 Vanderbilt, his wife, William Godfrey Vanderbilt, an infant, appearing herein by guardian, and Henry Mitchell, as medical superintendent of the bureau of vital statistics of the... state of New Jersey. The complainant charges that he is the husband of the defendant Myra L. J. Vanderbilt; that they were married in this state in Febru- ary, 1901, and then were, and are now, residents of this state; that they lived together as man and wife for two months after the marriage, and no longer; that from September, 1901, to July, 1903, the wife and a third party named lived together in adultery at a place designated in the bUl, and that during said period complainant had no matrimonial access to his wife; that as a result of the adulterous intercourse there was bom to the said wife, in the state of New Jersey, on or about the 20th day of October, 1903, a male child, by her named William Godfrey Vanderbilt, which infant is one of the defendants herein; that the complainant is not the father of the child, but that the infant is an adulterine bastard.
