The two elements of graft mentioned are the mem- bership fee graft and the court cost graft. It is hardly necessary to say a word about the membership fee graft, as everyone knows how absolutely rotten every phase of it is bound to be in ordinary practice. It is not so clear to many why the court cost graft has aroused such antagonism, nor is it so easy to see how the attorney has done more to encourage this system of graft than anybody, and on what grounds the attor- ney defends the practice a...nd encourages it. In this chapter we will make plain a number of facts in con- nection with court costs that may serve a good purpose.
In the first place, it should be distinctly understood that a request for actual costs, necessary to start any suit and prosecute it to a judgment, is not in any sense a "graft." If the practice of asking and securing the actual costs to reduce claims to judgment had been the one followed it would have eliminated one of the crying abuses complained of by the merchant.
