The moneys in the hands of the secretary of state were raised from the wages of mercha...nt seamen only, and should be applied only for the relief of that class of seamen which have contributed to the fund.

Sir: In compliance with the request contained in your note of the 25th instant, that I would give you my opinion on the construc- tion of the 4th section of the act of congress of February 28, 1803, in reference to the rendering pecuniary assistance by the consuls abroad to distressed seamen left at their consulates by United States vessels of war, I have the honor to state that, after a conversation with the Fifth Auditor as to the practice of the department, and on collating 483 Vol.
