You will note instantly that the two acts (the act of May 30, 1908, and the act of March 4, 1917) are very different in many respects. Under the provisions of the act of May 30, 1908, pension was granted "to the surviving officers and enlisted men of the Texas volunteers who served in the defense of the frontier of that State against Mexi- can marauders and Indian depredations, from the year 1855 to the year 1860, inclusive; * * * Provided further, that where there IS no record of enlistment or muster into the service of the United States in the service mentioned in this act, the fact of reimbursement to Texas by the United States, as evidenced by the muster rolls and vouchers on file in the War Department, shall be accepted as full and satisfactory proof of such enlistment and service.
