"Where an accused is not represented by a pleader there must be something on the face of the record to show that the provisions of § 296 (1) of the Criminal Procedure Code, entitling an accused person to be expressly informed of his right to give evidence on his own be ha...lf and as to what are the main points against him were complied with.
The facts appear in the judgment.
Wadsivorth for the accused-appellant. — When an accu- sed is undefended, § 296 (1) of the Criminal Procedure Code says that the Court shall inform him of his right to give evi dence and shall call his attention to the principle points in the evidence. The record does not show that this has been done in this case and the accused alleges in his petition of appeal that he was prejudiced by the omission on the part of the Magistrate to do so.
