Wadsivorth for the accused-appellant. — When an accu- sed is undefended, § 296 (1) of the Criminal Procedure Code says that the Court shall inform him of his right to give evi dence and shall call his attention to the principle points in the evidence. The record does not show that this has been done in this case and the accused alleges in his petition of appeal that he was prejudiced by the omission on the part of the Magistrate to do so.
