Except in the cases of soldiers in actual service and marines at sea, a will must be in writing. All persons, except idiots, persons of unsound mind, and infants may devise their real property. Every male person of the age of eighteen years or upwards, and every female of the age of sixteen years or upwards, of sound mind and memory, and no others, may give and be- queath their personal estate. Any citizen of a state or nation, which by its laws, confers similar privileges upon a citizen of the United States, may take, acquire, hold or convey lands, or real estate, within this state, in the same manner and with like effect as if such person were at the time, a citizen of the United States.
