Zierold: Yes. This was an example similar to that. It was not the best remedy because recognizing a deficiency in the rules and bringing a lawsuit to correct it might n
...ot correct it at all. There was no questioning the fact that the deficiency existed. But to bring a legal challenge which would result in the legislature, in a sense, sanctifying the deficiency, is not in my opinion a victory. Given the nature of the legislature and the Congress, this kind of thing does happen.
We're better off attempting to work within the existing structure and not subjecting it to the risk of modification, even though we are not going to win every time. On balance, it's wiser to maintain the system as it is, if there is no way in which we can control the reaction of the legislature.
