GSD uses the call back clause. The division has never used the charge back penalty clause but did use the cancellation clause once, in 1978. Department officials indicate they have used all three penalty clauses in enforcing contractor compliance, and believe use of these clauses has allowed them to obtain the level of service they desire with minimal instances of repeat problems. The division is specifically delegated responsibility for enforcing contracts in section 2.5.303, ARM.
