Notwithstanding the necessary relation between passenger and freight rates of the Carriers, and the wages paid their employees, the Act of Congress does not provide for the representation by the Interstate Commerce Commission in the arbitration proceedings under the Act, and we have ...had, therefore, in the past, decisions by arbitrators, increasing wages, without the slightest responsibility on the part of the arbitrators, with respect to the rates necessary to secure the funds to provide for such increases. Thus in the 1913 Arbitration between the Eastern Railways and the Order of Railway Conductors and Brotherhood of Railroad Trainmen, the report of the Arbitrators, in granting the increase said (page 29) : "The Interstate Commerce Commission, and not this Arbitration Board, has the duty ot de- termining whether the railroads can earn in addi- tion to their other charges, without an increase in freight rates, the rates of pay that this Board believes to be due at the present time to the con- ductors and trainmen, which rates are embodied in the Award following.
