AN OEDINANCE ) To authorize the opening of Brown street, from Forty-ninth to Fiftieth street.
Section 1. The Select and Common Councils of the City of Philadelphia do ordain. That the Department of Public Works be authorized and directed to notify the owners of property... over and through which Brown street, from Forty-ninth to Fiftieth street, w^ill pass, that at the expiration of three months from the date of said notices, said street will be required for public use : Provided, That before the said notices shall be issued all the owners of abutting property on said street, excepting Thomas Dine, shall first enter into an agreement not to claim any dam- ages for opening said street.
60 APPENDIX TO THE JOURNAL Sect. 2. Upon the filing of the agreements required in Section 1, the Mayor of the City is hereby authorized and directed to enter security on behalf of the City of Philadel- phia for the payment of any damages which may be as- sessed by reason of the opening of said street; upon the filing of said bond, and at the expiration of the said three months, the Director of the Department of Public AVorks shall forthwith proceed to open said street.
