The great end of the institution of our federal union, was, besides uniting the stales into one national sovereignty, and the citizens of each in a national character, to secure to the several stales the free, perfect and full exercise of the municipal sovereignty, within their re- spective local limits, except in those instances where the interest of the whole was considered to be alfected. With this view , a line of distinc- tion was drawn between national and municipal sovereignty, and cer-
...tain prohibitions and restrictions not inconsistent with the public good, imposed. These prohibitions and restrictions, however, do not affect the municipal sovereignly of the states when it is exercised as inciden- tal to its separate existence, for thepromolion of the general welfare; nor do thej destroy or abridge the national sovereignty, »vhen it is used *'for carrying into effect" the powers delegated by the constitution of the United States. The original states, who were parties to the na- tional compact, made its requisitions binding upon the several states, except so faras those requisitions did come in conflict with the primi- tive and ultimate sovereignity of the people of each state, who by their representatives acted separately for themselves and their respective communities.
