By this statute aU persons to the number of twelve or more, being unlawfully, riotously, and tumultuously assembled together, to the disturbance of the public peace, and not dispersing themselves within an hour after the proclamation is read to them by a proper magistrate, are made guilty of felony without benefit of clergy.
