It is to be noted that a prisoner's election to go to prison will not disqualify him if he had the option of paying a fine instead. OTHER DISQUALIFICATIONS 111 It will be observed that the disqualification which may be imposed under this sub- section is entirely within the discretion of the court. This provision was added to by Section 4 (3) of the Act of 1911. This section provides that any pensioner who is convicted of an offence covered by the First Schedule to the Inebriates Act, 1898, and who is not already disqualified by reason of the principal Act, is to be disqualified for a pension for six months after his con- viction, unless the court otherwise direct.
