Of course, it must also be recognized that a departure from bid specifications will sometimes be tolerated, in the dis- cretion of the awarding authority where the defect is so insub- stantial as to bring into operation the doctrine of de minimis .
(See: Cal. Civil Code, §3533.) This is particularly true where the defect does not violate the positive terms of a statute or ordinance, but merely violates bid specifications inserted by ad- ministrative action of the contracting authority.
