Thus a bare enumeration of the prohibitions of the acts of States leading to combinations to levy war agfiinst the United States, and of those powers which enable the United States to provide means, to carry oh war, cause the laws to be duly ex- ecuted, and to suppress insurrections, discloses an authority in the Constitution of the most express and plenary kind, to put down rebellions, whether of States or individuals, by force of arms. Let us now notice the statutes of Congres...s, passed to carry out these high powers, and vesting in the President the authority to enforce the execution of the laws, and put down insurrections. The Act of 28th February, 1795, provides that " whenever the laws of the United States shall be opposed, or the execution thereof obstructed in any State by combinations too powerful to be suppressed by the ordinary course of judicial proceedings, or by the powers vested in the marshal in this act, it shall be lawful 14 for the President of the United States to call forth the militia of such State, or of any other State or States, as may be neces- sary to suppress such combination, and to cause the laws to be duly executed.
