This law ought, however, to prohibit only those actions which are harmful to society, and no one may be forbidden to do what is not prohibited by the law nor be forced to do what that law does not commend. The law is regarded as the expression of the public will. All citizens, therefore, have the right to participate di- rectly or indirectly through their representatives in its formation. It must be the same for all.

In other parts of the constitution other rights are recognized, such as the right of citizens peace- ably to assemble, to decide their controversies by way of arbitration, and not to be tried by judges other than those provided by law.
