16 Q. B. D. 279. LTV VICTORIA. 21§ But in the present cases there is only one house in- volved. By mistake it has been described as "free- iiold," and it turns out to be " leasehold " of sufficient value to support the vote. The objector has had the opportunity of informing himself about the house, and I do not think he is prejudiced by the amendment' I think it is the kind of mistake which may be altered,- and to which sub-sec. (12) applies. I think the effect of sub-sec. (13) is to prevent an... amendment which would alter the description of the qualifying premises in such a way as to become an entirely different pro- perty and qualification, and I appreciate the decision in Foshett v. Kaufman {a) as applicable to such a set of circumstances. I agree that, except under tl^e provi- sions of section 24, the voter is not entitled to bring forward an entirely new claim by way of amendment, but I do not thiuk that this rule prevents the amend- ment which has been made in the present case. In my opinion, therefore, the appeal ought to be dismissed; but, as the majority of the Court are of the contrary opinion, the appeal will be allowed.
