Where total or partial incapacity for work results from the injury, a weekly payment shall be made during the in...capacity after the second' week, not exceeding fifty per cent, of his average weekly earnings dur- ing the previous twelve months, if he has been so long employed, bub if not then for any less period during which he has been in the em- ployment of the same employer, such weekly payment not to exceed' $4.87. This act contains many other provisions as to notice and pro- cedure. It is supplemental to the other laws affecting the relations be- tween employers and employes and does not deprive the employe of his- right of action for an injury which was caused by the personal negli- gence or the wilful act of the employer or of some person for whose- act or default the employer is responsible.
