The house being on the land when James M'Kee took his lease in 184j6, by whomsoever built, he took it as the landlord's property. This result follows necessarily from the opinion I have formed on the question of " predecessor in title," as this case in respect of the house would be not alone in principle, but almost in fact, the same as Solt v. Sarherton (1). It becomes unnecessary to decide whether, on another point suggested in argument, the same result should not be ar- rived at. The widow D...unseath's husband bought, with other pro- perty,' the reversion expectant on the lease to M'Kee, in the Incumbered Estates Court, in 1851, and a conveyance was executed to her by the Judges of that Court. That conveyance, by statutable and indefeasible title, conveyed to the purchaser the estate as then improved, subject only to the lease of 1846, and any rights flowing /row it — I say emphatically " from it," but with no reservation of any rights, real or imaginary, that would flow, or might be supposed to flow, from anything done at an earlier period than the date of the lease.
