He had been mixed up with all the political movements of the time, of course on the Whig side. He had been a Commissioner for the Union of the Parliaments. He was after- wards an Extraordinary Lord of Session, and in 1710 was made Lord Justice-General of Scotland. As such he was head of the Justiciary-Court, though 128 R. L. S. it was not the habit of the particular noblemen who held the office to sit there. As late as 1830 the Lord Justice-General was a different person from the Lord President... of the Court of Session. The latter was always a professional lawyer; the first was not, but was usually some great nobleman. The Duke, as it happened, had not merely received a special legal training, but was a man of wide culture. He was a great collector of books, his library being one of the best in Britain. It is to be noted that before 1747 Argyll as " superior " (in the Scots law phrase) of the land that comprises the Campbell territory would have had the right of trying criminals within that territory, together with the power of pit and gallows — that is, putting them to death when convicted.
