The law also needs to recognize the primary role of State govern- ments in overseeing voluntary cleanups. A congressionally-determined risk exposure standard would be very helpful in this case to allow States to determine whether a site has been cleaned up sufficiently to relieve the responsible par- ties of CERCLA liability. We understand... that Congress will be debating whether Superfund's retroactive liability should be retained. The governors have supported the current strict, joint, and several liability struc- ture, and 40 States have enacted legislation based on this model. Obviously, a weakening of this standard would mean that more sites would require public funds. This money will be difficult to ob- tain in the current budgetary climate — and I might say both here and there. We urge Congress to consider the consequences not just for the 1, 300 sites on the national priority list, but also for the 30, 000 other sites that have been identified across the country.
