509. 124 FOREST LAW IN AMERICA Massachusetts. A Massachusetts act of June 5, 1907 ^ amended the existing law ^ as to the appointment of forest firewards so as to require the mayors and aldermen of cities as well as the selectmen of towns, to appoint annually in March or April a "forest warden"; to require the approval of the state forester before such appointment should be- come effective; and to subject the appointee to a forfeit of ten dollars for a failure to file with the city or town clerk... his acceptance or refusal within seven days of the receipt of the notice of appointment. Forest wardens were charged with the duty of taking active measures to prevent and sup- press forest fires. In addition to posting notices, they were required to investigate and report to the state forester re- garding the causes, extent and damage of forest fires, the value of forest lands, the extent of cutting operations and the prevalence of insect pests injurious to forest growth. The wardens were given the powers formerly vested in forest firewards as to compelling assistance in the fighting of forest fires and were exempted from actions for trespass while engaged in the reasonable performance of their duties.
