For my part, in view of the conflict in these two decisions by the same court and the same judges, these two being the only ones, I feel free as a federal judge under well-settled principles laid down by the Supreme Court to guide me in such cases to wholly reject the prin- ciples laid down in this case of Grafton & Belington R. R. Co. v. Buck- hannon & Northern R. R. Co., and hold in accordance with those of the Railroad Co. v.
