Lag and others of the party found themselves clapped up in the Tolbooth, the ancient prison of Edinburgh.^ The imprisonment to which these gentlemen were subjected was no child's-play, no mere formality. Throughout the year in question the public jails, especially the Edinburgh Tolbooth, * History, vol. Vii. P. 337. * 8th July 1689. 'The Lord High Com'^ His Grace and Lords of his Matie^ Privy Council do heirby grant warrant to incarcerat the Laird of Lagg within the Tolbooth of Edinr. Till furd...er order. * — MS. Records of Privy Council. 98 THE LAIRD OF LAG were crammed with prisoners, as the number of petitions for release, to be found in the Privy Council Records, show. The miseries to which the unfortunate inmates were exposed could perhaps be properly realised only by one who remembered the narrow, gloomy interior of the old Edinburgh Tolbooth. It gave the idea — as he writes — of the crowd of prisoners packed in it ^ much like the inmates of an emigrant ship. ' ^ Only three months before the date of these occurrences the new Government, under the pre- sidency of the Duke of Hamilton, had adopted their ' Declaration of Estates and Claim of Right, ' by which it was sought to render it illegal to imprison persons without expressing the reasons of their confinement.
