Court will not make an order at the instance of ...a creditor who appears in support of the petition {y). But where a member of a benefit building society petitioned as a creditor, he was allowed to amend his petition by stating that he was a creditor only in respect of money advanced by him as a member (z).
In several recent cases, leave has been given to amend a " demurrable " petition (a).
An order will be refused if a sufficient case is not stated on the petition. It is not enough that a sufficient case is shown in evidence (6). Where a sufficient case is not alleged, the petition, according to the expression now commonly used, is "demurrable " (c).
