Iers, who should try the case de novo, and to give notice to all con- cerned, of the time and place of trial, and if necessary, to issue sum- mons for the witnesses. This seemed to secure, in the best way I could devise, co:isistent!y with the law, an impartial administration of it. Sec. 31. Tiic right of nppeal, in casns not capital, and to afford sufficient time in such cases, for an application for pardon, ought to be provided for. For many are the errors and abuses of power com- mitted in this behalf. The whippings inflicted by the sentence of Courts trying slaves and free negroes, are most enormous— utterly disproporlioned to otfences. And should be prevented by all the means in our power.
