This re-enacts a provision contained in the 4th section of the Factors Act, 1842. It enables a mercantile agent, who has pledged goods for less than their value, to effect a further pledge of the same goods for the surplus value remaining after satisfying the first pledgee's claim ; being the extent to which the first pledgee holds the goods subject to the agent's control and on his behalf (b).
