To those who think that there is a distinction to be drawn for the purpose of exemption from tolls between vessels ^gaged in the coastwise trade and those engaged in foreign frade, this question of the vessels which may be said to have both rights is of importance. If the view expressed by ex- President Roosevelt, that we have the right to exempt our Coastwise vessels, because to do so involves no discrimination against the vessels of other countries, be accepted it is clear that a coastwise ve...ssel with the right to touch and trade at foreign ports during its coastwise voyage would be excluded, because by carrying cargo and passengers from foreign ports they would come in immediate competition with the vessels of Other nations. In Olsen v. Smith (195 U. S., p. 332), which has been fre- quently cited during the debate on the tolls, the court took sub- skantially the same ground in reference to the general favored- nation clause as that taken by ex-President Roosevelt in regard to canal tolls.
