If an adult accepts discipleship, he, by the very act of acceptance, places himself under the authority of his leader. The teacher is older than the State. Hence when the State arrived, it must of necessity recognize the teacher, and in recognizing him it recognized his au- thority. Thus there has grown... up in the common law the accepted definite principle that the teacher, wherever found and whatever his exact status, must be supported with some measure of authority. It has remained for statute law to give some accurate defini- tion of this measure. And as the public school teacher has become a part of a complicated system, we must look for these definitions within the larger body of general school law. When the government of the United States was formed, the States, it seemed, did not specifically transfer the control of their schools to the Federal Government.
