No person shall be deemed to have committed f^r^ifa°ts an offence against this Act for doing or causing to be done any of the following acts (that is to say) : — (1) Constructing, improving, or maintaining in or across any river or stream any building, bridge, weir, dam, sluice, or other permanent work with necessary temporary coffer dams and other works which but for the passing of this Act he would have a legal right to do ; 70 WEST RIDING OF YOnKSHlEE IHVERS ACT, 1894. § 6 There is nothing in the Act giving the Rivers Board jurisdiction in the case of a permanent building wrongfully erected in a stream. This sub-section must, therefore, be considered as a precautionary measure, except so far as it may remove from the scope of sect. 5 solid matter necessarily deposited in a stream in carrying out works which, apart from this Act, might legally be constructed.
