Wher- ever it is established, it is set up by the express author- ity of the Parliament at home clothed in an Act, and although Parliament would not, and it may be said, could not, withhold representative government where fit conditions exist, ...it is the formal duty of Parliament itself to recognise the fitness of the conditions and there- upon to legislate. It may be argued that if Parliament could not withhold its sanction to the institution of representative government within any colony, that col- ony has a right to receive it; just as a son has a right to liberty where the father could not refuse it. But the analogy is imperfect since there is no legal authority to overrule the relation of Parliament and Colony, as there is to overrule the relation of father and son.
