The defendant was prosecuted for a violation of this statute. He admitted the sale, but offered evidence tending to show that the milk was carelessly adulterated by his servant, whom he had expressly cautioned to take care that nothing of the sort should be done, and that he, defendant, was personally wholly blame- less. He asked an instruction that if this evidence were believed he should be acquitted.
