2nd. It is deemed criminal " that the Gover- nor issued a commission, with a blank for the names of the commissioners, to his son Joseph B. M'Kean, who inserted the names of the commissioners, who were to take the testimony, and afterwards appeared as counsel for William T. Donaldson, the adverse candidate." ■ It is answered', that by the law, the Gover- nor is authorised to appoint Commissioners; but the mode, in which the appointment shall be made, is not prescribed . If any person be au- tho...rised to do a particular act ; after it is done by another, it is as valid in the execution of the authority, generally speaking, as if he had done it himself. • It was found difficult to ob- tain commissioners; and when a third com- mission issued in blank j it was ' accompanied with a list of names framed by the Governor, from which all the commissioners except one were taken. In the strictest sense of the word, therefore, those commissioners were appoint- ed by the Governor. ■ Mr. HallowePs name, however, was not in the list ; but the inser- tion of his name in the commission, was ap- proved and adopted by the Governor, before the commissioners proceeded to execute their trust.
