To a strict legal jointure under the statutes of uses, which is in force in the United States as a part of the common law, so far as consistent with modern statutes, the following are the requisites: — ( 1 ) the provision must consist of an estate or in- terest in land; (2) it must take effect in possession or profit, immediately from the death of the hus- band; (3) it must be for the wife's life, at least; (4) it must be limited to the wife herself, and not in trust for her; (5) it must be made in satisfaction of her whole dower, and must be so expressed in the deed; (6) it must be a reasonable and com- petent provision for the wife's livelihood; (7) it must be made before marriage.
